1. General
By accessing and placing an order through greenfocusfarms.ca (the "Website"), you confirm that you are in agreement with and bound by these Terms & Conditions. These terms apply to all visitors, users, and customers of Green Focus Farms, operated by Les Fermes Fondi Inc., a company incorporated in Canada.
If you do not agree with these Terms & Conditions, please do not use this Website.
2. Products & Availability
2.1 All products listed on this Website are subject to availability. Green Focus Farms grows fresh, seasonal produce — availability varies by growing season, harvest conditions, and weather. We reserve the right to limit quantities or substitute products of equal or greater value when necessary.
2.2 Product photographs are for illustrative purposes only. Actual products may vary slightly in appearance, size, and colour depending on the harvest.
2.3 All prices are listed in Canadian dollars (CAD) and are subject to change without notice. Prices at the time of order confirmation are the prices that apply to your order.
2.4 Green Focus Farms reserves the right to cancel or refuse any order at any time, including after confirmation, if a product becomes unavailable, if there is an error in pricing, or if we are unable to fulfil the order due to circumstances beyond our control.
3. Orders & Payment
3.1 Placing an order through this Website constitutes an offer to purchase. Your order is confirmed only upon receipt of our written or electronic confirmation.
3.2 For pre-season and preorder purchases, a deposit may be required to secure your allocation. Deposits are non-refundable unless Green Focus Farms is unable to fulfil the order.
3.3 Payment is accepted through the payment methods available at checkout. All transactions are processed securely through Shopify's payment infrastructure.
3.4 Green Focus Farms reserves the right to request additional verification before processing any order.
4. Delivery & Shipping
4.1 Green Focus Farms ships fresh produce across Canada. Delivery availability, timelines, and rates vary by province and are displayed at checkout.
4.2 Quebec and Ontario are our primary service zones. Full delivery service is available across these provinces.
4.3 Western Canada (MB, SK, AB, BC) orders are fulfilled via our distribution partners. Delivery windows may vary. We will contact you to confirm availability and scheduling before processing.
4.4 Atlantic Canada and Northern Territories (NB, NS, PEI, NL, NT, NU, YT) — due to extended transit times and the perishable nature of fresh produce, shipping to these regions is challenging. We strongly recommend contacting us before placing an order to discuss feasibility.
4.5 Delivery dates are never guaranteed. Due to the perishable and seasonal nature of our products, estimated delivery dates are provided as a guide only. Green Focus Farms will manually confirm your delivery date separately after your order is placed. Please do not schedule meal preparation based on estimated dates alone.
4.6 Green Focus Farms is not responsible for delays caused by shipping carriers, weather conditions, customs, or other circumstances beyond our reasonable control.
5. Farm & Pickup Locations
5.1 Farm and pickup are available at the following locations, strictly by appointment only:
- Carlsbad Springs Farm: 5320 Thunder Road, Carlsbad Springs, ON, K0A 1K0 (≈ 20 min from downtown Ottawa)
- Papineauville Farm: 956 Rte 321, Papineauville, QC, J0V 1R0 (≈ 45 min from Gatineau)
- Gatineau Pickup Point: 3-104 Rue Katimavik, Gatineau, QC, J9J 4E7
5.2 No walk-in visits are permitted without a confirmed appointment. Green Focus Farms reserves the right to refuse entry to anyone without a confirmed appointment.
5.3 Customers are responsible for arriving at the agreed time. Missed pickups without prior notice may result in forfeiture of the order.
6. Perishable Products — Special Conditions
6.1 All produce sold by Green Focus Farms is fresh and perishable. Once a product leaves our farm or fulfilment point, it is the customer's responsibility to store it appropriately.
6.2 Refrigerate all fresh produce immediately upon receipt. Shelf life guidelines are provided on each product page and should be followed closely.
6.3 Green Focus Farms is not responsible for product deterioration resulting from improper storage after delivery or pickup, or from delays caused by the customer's unavailability to receive the order.
6.4 If your order arrives in unsatisfactory condition due to a fault on our part (e.g. packing error, transit damage within our control), please contact us within 24 hours of receipt with photographs. Claims made after 24 hours cannot be processed due to the perishable nature of the products.
7. Returns & Refunds
7.1 Due to the perishable nature of fresh produce, we do not accept returns.
7.2 If you receive a product that is damaged, incorrect, or significantly different from what was ordered, please contact us within 24 hours of delivery or pickup at info@greenfocusfarms.ca with:
- Your order number
- A clear description of the issue
- Photographs of the product as received
7.3 Approved claims may be resolved through a partial or full refund, store credit, or replacement at our discretion, depending on availability and circumstances.
7.4 Refunds for pre-season deposits are only issued if Green Focus Farms is unable to fulfil the confirmed order. Deposits are otherwise non-refundable.
7.5 Refunds will be processed to the original payment method within 5–10 business days of approval.
8. Substitutions
8.1 In the event that an ordered product is unavailable at the time of fulfilment, Green Focus Farms may offer a substitution of equal or greater value. We will contact you before making any substitution. You may accept the substitution or request a refund for the unavailable item.
9. Intellectual Property
9.1 All content on this Website — including text, images, logos, product descriptions, and graphics — is the property of Green Focus Farms (Les Fermes Fondi Inc.) or its content suppliers and is protected by applicable Canadian copyright laws.
9.2 The Terra Bantu brand name and associated assets are proprietary to Les Fermes Fondi Inc. Unauthorised use is prohibited.
9.3 You may not reproduce, distribute, or use any content from this Website without prior written permission from Green Focus Farms.
10. Privacy
10.1 Green Focus Farms collects and uses personal information in accordance with our Privacy Policy, available on this Website. By placing an order, you consent to the collection and use of your information as described in our Privacy Policy.
10.2 We do not sell or share your personal information with third parties except as required to fulfil your order (e.g. shipping carriers) or as required by law.
11. Limitation of Liability
11.1 Green Focus Farms shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of this Website or from the purchase or use of our products, to the maximum extent permitted by applicable Canadian law.
11.2 Our total liability to you for any claim arising from a purchase shall not exceed the amount paid by you for the product(s) in question.
11.3 Green Focus Farms does not make any medical or nutritional claims about its products. Information provided on this Website about the nutritional or medicinal properties of our vegetables is for informational purposes only and should not be taken as medical advice.
12. Governing Law
These Terms & Conditions are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes arising from these terms or from your use of this Website shall be subject to the exclusive jurisdiction of the courts of Quebec.
13. Changes to These Terms
Green Focus Farms reserves the right to update or modify these Terms & Conditions at any time without prior notice. The date of the most recent revision is shown at the top of this page. Continued use of the Website following any changes constitutes your acceptance of the updated terms.
